TERMS OVERVIEW

These Terms govern your use of the proprietary 1Bitcoin Platform (“Platform”) operated by 1Bitcoin Inc. and its affiliates (“1Bitcoin.ca,” “1Bitcoin,” “we,” or “us”), which is accessible through our website. These Terms apply to all services provided by 1Bitcoin.ca, including the facilitation of Bitcoin transactions and any features or tools introduced in the future.

Plain-Language Risk Warning:

Bitcoin is a volatile digital commodity. Its value can rise or fall quickly, and you may lose the full amount you spend. Transactions are irreversible once sent to the Bitcoin network. 1Bitcoin.ca is a non-custodial platform — we do not hold Bitcoin for you after settlement, and you are solely responsible for the safekeeping of your Bitcoin once delivered.

Your continued use of the Platform after any changes to these Terms will constitute your acceptance of such changes. For material changes, we will provide reasonable notice by email or through the Platform before they take effect.

SECTION 1 – ELIGIBILITY

You may use our services only if:

(a) You are at least 18 years old;

(b) You are a citizen or resident of Canada; and

(c) You have a valid Canadian government-issued ID.

You agree that services may require additional eligibility checks, including providing more information or completing further verification before transactions can be processed. Failure to meet or maintain eligibility may result in suspension or termination of access.

SECTION 2 – PRIVACY

We protect your privacy in accordance with our Privacy Policy, which is incorporated into these Terms. As a regulated money services business, we may be required to share your information with:

  • The Financial Transactions and Reports Analysis Centre of Canada (FINTRAC);
  • Other regulatory or law enforcement agencies;
  • Credit bureaus and identity verification partners;
  • Financial institutions involved in processing your transactions.

You acknowledge that you have reviewed and understood our Privacy Policy.

SECTION 3 – REGULATORY STATUS

1Bitcoin Inc. is a federally registered money services business (MSB #M21226416) regulated by FINTRAC.

We are not affiliated with the Canadian Investor Protection Fund (CIPF), the Canada Deposit Insurance Corporation (CDIC), or any other investor protection scheme. Bitcoin purchased through 1Bitcoin.ca is not insured or guaranteed.

SECTION 4 – NON-CUSTODIAL SERVICE

1Bitcoin.ca is a non-custodial platform. We facilitate the purchase and sale of Bitcoin only and do not hold client Bitcoin balances after transaction settlement.

Bitcoin purchased through the Platform is delivered only to the verified Whitelisted Wallet associated with your account at the time the transaction is executed. Customers are responsible for ensuring their Whitelisted Wallet address is accurate
before confirming it.

Funds deposited through the Platform are accepted solely for the purpose of purchasing Bitcoin. Access to certain features of the Platform may require that you first designate and verify a Whitelisted Wallet.

Once accepted, deposits are automatically applied toward a Bitcoin purchase in accordance with your order and are not maintained as an account balance for future use.

You are solely responsible for the accuracy of your Whitelisted Wallet address and for safeguarding your Bitcoin after delivery. We cannot recover Bitcoin sent to an incorrect or compromised address.

Canadian dollars (CAD) received from you are held temporarily for the sole purpose of completing your transaction and are not stored as deposits.

SECTION 5 – WHITELISTED BITCOIN WALLETS

Every customer must designate, verify, and maintain at least one active Whitelisted Wallet before accessing or using the Platform to purchase Bitcoin.

A Whitelisted Wallet is a Bitcoin wallet address that has been designated, verified, and approved through the Platform for receiving Bitcoin purchases.

By accessing the Platform, you acknowledge that an active verified Whitelisted Wallet is a mandatory requirement for using our services. You will not be able to access or use the Platform to conduct transactions until a Whitelisted Wallet has been successfully added, verified, and activated in accordance with our security procedures.

You agree that:

  • Bitcoin purchases will only be delivered to your active verified Whitelisted Wallet.
  • You are solely responsible for ensuring your wallet address is accurate.
  • You are responsible for maintaining control of your wallet.
  • Bitcoin sent to an incorrect wallet address cannot be recovered.
  • Wallet addresses must be verified by email before becoming active.

For security purposes:

  • Newly added or modified Whitelisted Wallets are subject to a security activation period before becoming active.
  • The duration of the security activation period may change from time to time.
  • Wallet changes require email verification and may require multi-factorv authentication.
  • Wallet changes cannot be completed while a deposit or Bitcoin purchase is pending.
  • Any requested wallet change will not affect deposits or purchases already in progress.
  • 1Bitcoin.ca may delay, reject, or require additional verification of any wallet addition or modification where fraud, unauthorized access, or security concerns are suspected.

SECTION 6 – ACCOUNT CREATION AND KYC

To use our services, you must create an account and complete our Know Your Customer (KYC) verification process. By opening an account, you agree to:

(a) Provide accurate and truthful information;

(b) Keep your information updated;

(c) Secure your account credentials;

(d) Notify us immediately of any suspected unauthorized access;

(e) Accept responsibility for all activity under your account; and

(f) Not create multiple personal accounts to bypass restrictions.

Services will not be provided until KYC verification is complete. We may require periodic re-verification.

We may require customers to verify ownership or control of a destination Bitcoin wallet before permitting transactions.

SECTION 7 – PROHIBITED USES

You agree not to use our services for:

  • Illegal gambling, fraud, money laundering, terrorist financing, or prohibited activities under Canadian law;
  • Market manipulation or securities law violations;
  • Circumventing platform restrictions or exploiting technical issues;
  • Misrepresenting your identity or providing false information;
  • Engaging in automated scraping, bots, or unauthorized application integrations.

Violations may result in account suspension, investigation, loss recovery fees, and reporting to authorities.

SECTION 8 – TRANSACTION EXECUTION

Deposits are accepted solely for the purpose of purchasing Bitcoin.

Once your deposit has been accepted for processing, your purchase will be executed in accordance with our operational procedures and delivered to your active verified Whitelisted Wallet.

Execution times may vary due to operational, compliance, fraud prevention, banking, network, or technical requirements.

1Bitcoin.ca is not responsible for delays caused by scheduled maintenance, technical issues, banking interruptions, blockchain congestion, or circumstances beyond our reasonable control.

We reserve the right to delay, suspend, or refuse execution where additional review is required.

A transaction is deemed complete once the purchased Bitcoin has been broadcast to the Bitcoin network and sent to the customer’s active verified Whitelisted Wallet.

SECTION 9 – TRANSACTION FINALITY

Bitcoin transactions are irreversible once broadcast to the network. 1Bitcoin.ca cannot reverse, cancel, or refund a Bitcoin transaction after it has been sent.

Customers are responsible for verifying the accuracy of their Whitelisted Wallet address before confirming it.

Once a wallet has been verified and a transaction has been executed, Bitcoin cannot be recovered if the address was entered incorrectly or if the customer no longer controls the destination wallet.

SECTION 10 –  – THIRD-PARTY LINKS & SERVICES

We are not responsible for the content, accuracy, or security of third-party services or websites linked through our platform. Any engagement with third-party services is at your own risk.

SECTION 11 – ACCOUNT LIMITATIONS OR TERMINATION

We may suspend, restrict, or close your account at our discretion if you violate these Terms or applicable laws. Actions may include:

  • Disabling trading;
  • Requiring liquidation of holdings;
  • Returning eligible Canadian dollar funds to the originating financial institution where permitted by law;
  • Reporting activity to regulators or law enforcement.

SECTION 12 – INDEMNIFICATION

You agree to indemnify and hold harmless 1Bitcoin.ca, its affiliates, officers, and employees against claims, losses, or expenses arising from your use of the services or breach of these Terms.

SECTION 13 – TAX RESPONSIBILITY

You are solely responsible for determining, reporting, and paying all taxes related to your Bitcoin transactions. We do not provide tax advice or file taxes on your behalf.

SECTION 14 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, our liability is limited to the greater of $100 CAD or the total fees you paid to us in the past 12 months for the relevant service. We are not liable for indirect, incidental, or consequential damages.

We are not liable for losses arising from:

  • compromised customer email accounts;
  • compromised authentication credentials;
  • unauthorized access to a customer’s account where our security procedures were followed;
  • loss of access to a customer’s Bitcoin wallet;
  • incorrect wallet addresses provided by the customer.

SECTION 15 – DISPUTE RESOLUTION

You agree to first attempt to resolve disputes with our support team. If unresolved within 30 days, disputes will be settled by binding arbitration in Ontario, Canada. You may opt out of arbitration within 30 days of accepting these Terms by notifying us in writing.

SECTION 16 – GOVERNING LAW

These Terms are governed by the laws of Ontario and the federal laws of Canada.

SECTION 17 – ENTIRE AGREEMENT

These Terms, along with our Privacy Policy and other posted policies, form the entire agreement between you and 1Bitcoin.ca.

SECTION 18 – CHANGES TO TERMS

We may update these Terms from time to time. For material changes, we will provide at least 14 days’ notice via email or the Platform. Your continued use of our services after such notice will constitute acceptance of the new Terms.
